Abstract

The research investigate the extent to which the Brazilian prison system turns the convicted into Homo Sacer, the societal paradigm presented by Agamben, reducing them to a mere “Naked Life”. To do so, in a qualitative way, the bibliographic method is initially used to define the concepts that affect the theme and then presents statistical data on the Brazilian prison system. Thus, it is possible to prove the hypothesis that if the prisoner has rights and guarantees established by law, but these are not enforced by the State, then it is identified with the condition of Homo Sacer.
