This article aims to discuss how fashion, through traditional costumes, and intellectual property laws can be used to preserve cultural heritage. By investigating the intersection between fashion and intellectual property rights, this study seeks to explain how these spheres can contribute to the safeguarding and valorization of intangible cultural resources. The overall objective is to analyze how fashion and intellectual property mechanisms can contribute to the preservation and valorization of cultural heritage. Therefore, the specific objectives seek to conceptualize what fashion, cultural heritage, and intellectual property are; to examine the legal mechanisms of intellectual property and cultural heritage protection available for the protection of cultural elements and, consequently, to identify examples of initiatives in fashion that aim to preserve and valorize cultural heritage, both successes and failures, to understand the determining factors in each situation. The methodology used in this study is deductive, with a qualitative, analytical, and bibliographic approach.
