Abstract

This paper proposes to present, in a conceptual way, the new monetary mechanisms in the form of electronic currencies, such as so-called cryptocurrencies, as well as to analyze the legal nature of Bitcoin and its effects on the brazilian legal system, verifying how brazilian law classifies the a priori institute. The research method was essentially bibliographic, analyzing scientific articles, institutional documents and doctrines. Due to the technical specificity of cryptocurrencies, the study was limited to electronic currency called Bitcoins. Initially, a brief history of the emergence of Bitcoins was presented in order to clarify this innovative proposal for online electronic financial transaction. Subsequently, the basic concepts, characteristics and operating mode of these were changed. Once the technical assumptions indispensable to the present study are defined, the functions of Bitcoins such as online money, their benefits and challenges in relation to volatility are analyzed, and mainly the legal aspects in relation to security and purpose features.
