The characteristics of the emancipates in the 1st Notary Public Office and Protest of Titles in the city of Canoinhas-SC between 1970 to 2020

The present article is the result of a research whose objective was to investigate the characteristics of the emancipated in the Notary Public Office of Canoinhas-SC between the period of 1970 and 2020. Documentary, historical and bibliographic contributions were used for the research, as well as exploratory methodologies, considering the in loco data of the 1st Notary Office of Notes and Protest of Titles in the city of Canoinhas -SC. A comparison was made between the Civil Code of 1916 and 2002 and regarding the legal changes regarding extrajudicial emancipations. To complement the main objective, the bibliographical research sought to present the number of emancipated people and which is the most predominant gender. Thus, the study is justified by the fact that there is no research, especially in the field, with data related to extrajudicial emancipations in the highlighted period. With the increase in the participation of women in society, it is clear that there was a gradual growth of the female gender in emancipations, along with the number of emancipations made over the years. The first section aims to compare the Civil Codes of 1916 and 2002, identifying the changes and presenting the extreme difference between them. The second section aims to expose the forms of capacity and incapacity. The third section presents the forms of emancipation, parental responsibility towards the emancipated, and ending with the exposition of data collected from the 1st Notary Office of Notes and Protest of Titles in the City of Canoinhas-SC.
