The constitutionality of the differentiated disciplinary regime

Considering that the Differentiated Disciplinary Regime imposes a more severe isolation on specific prisoners while serving their sentences, in order to maintain discipline in prison units, the relevance of the issue is revealed through the crisis in the Brazilian prison system, which exposes the overcrowding, which could lead to loss of control over prisoners. In this way, the objective is to present the reasons for the creation of the RDD, identify its main characteristics and analyze the compatibility of the RDD with the constitutional principles. A deductive methodology was used, with bibliographic review technique. Finally, it was possible to verify the compatibility of the RDD with constitutional principles, concluding that there is no constitutional violation or human dignity.
